By creating an account, placing an order, or using the Site, you agree to these Terms, our Privacy Policy, and our Refund and Returns Policy. If you do not agree, do not use the Site.
1. Who may use the Site
You must be at least 18 years old and able to form a binding contract. You agree to give accurate information and keep your login secure. You are responsible for activity on your account.
2. What we offer
We offer digital nursing exam study resources, including downloadable files and online access. You are getting a license to use the content, not ownership of it.
3. License and restrictions
Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content you ordered, for your own study. Some products may have a limited access period, which will be stated in the product description.
You may not: share your account or login; copy, redistribute, resell, post, or publish the content; remove ownership notices; scrape the Site; or bypass access controls.
Access may be revoked if your payment is refunded or reversed, or if you violate these Terms. We may suspend or end accounts that violate these Terms.
4. Study aid only; no guarantee
Our content is for exam preparation and general education. It is not medical, nursing-practice, legal, or clinical advice, and you must not use it to make patient-care decisions. We do not guarantee that you will pass any exam or reach any score. NurseExamPass is not affiliated with or endorsed by any exam owner or licensing body.
5. Prices, orders, and payment
Prices are in U.S. dollars and are shown at checkout. Taxes are added where required. You authorize us and our payment processor, Stripe, to charge your payment method for your order. We may cancel and refund an order that was placed at an obviously wrong price or that we suspect is fraudulent.
6. Refunds
Delivered digital products are final sale, except as stated in our Refund and Returns Policy and as required by law.
7. Other products offered in the future
We may offer other products in the future. Any such product will be offered under additional terms that we disclose to you before you buy. Those additional terms apply to that product together with these Terms.
8. Intellectual property
The Site and its content, including text, questions, explanations, graphics, logos, and software, belong to us or our licensors and are protected by copyright, trademark, and other laws. These Terms give you no ownership. If you believe content on the Site infringes your copyright, email info@nursingexamsources.com with enough detail for us to find and review it.
9. Feedback
If you send us feedback, you allow us to use it without obligation to you.
10. Electronic communications
You agree that we may send you service messages by email, such as order confirmations, receipts, access instructions, refund and account notices, and security messages. Our Privacy Policy explains how we use your information.
11. Disclaimers
To the fullest extent the law allows, the Site and content are provided “as is” and “as available,” without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will be uninterrupted or error-free, or that the content is free of errors. Some states do not allow limits on implied warranties, so this may not apply to you.
12. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Site or content is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, willful misconduct, or violation of law.
13. Indemnity
To the extent the law allows, you will indemnify us for claims arising from your violation of these Terms or your misuse of the content.
14. Termination
You may stop using the Site at any time. We may suspend or end your access for violation of these Terms, non-payment, fraud, or legal reasons. Sections that by their nature should continue after termination will continue.
15. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and without taking away consumer protections that apply to you under the law of the state where you live. Before filing a claim, please email info@nursingexamsources.com so we can try to resolve it informally for 30 days. Either of us may bring an eligible claim in small-claims court. Any other claim must be brought in the state or federal courts located in California.
16. Notice to California users
Under California Civil Code Section 1789.3, California users may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17. General
These Terms and the policies they refer to are our entire agreement with you about the Site. If a provision is found unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms; we may assign them as part of a business transfer. We may update these Terms. We will post the new effective date and give notice of material changes. Using the Site after the effective date means you accept the update.
